DMCA COPYRIGHT POLICY

KRAK (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of mykrak.com (the “Site”) to do the same.

In accordance with the Digital Millennium Copyright Act (“DMCA”), we respond to properly submitted claims of copyright infringement.

3. COUNTER-NOTIFICATION PROCEDURES

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification.

Your counter-notification must include:

  • Your physical or electronic signature

  • Identification of the material removed and its prior location

  • A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification

  • Your name, address, and telephone number

  • A statement that you consent to the jurisdiction of the federal court in your district (or the district where you are located)

  • A statement that you will accept service of process from the person who submitted the original DMCA notice

Upon receipt of a valid counter-notification, we may restore the material unless the original complainant files a court action.

4. REPEAT INFRINGER POLICY

We may terminate user accounts or access privileges for users who are determined to be repeat infringers of intellectual property rights.

5. MISREPRESENTATIONS

Any person who knowingly submits a false claim of infringement or a false counter-notification may be liable for damages under applicable law.

6. LIMITATION OF LIABILITY

We reserve the right to remove or disable access to any content alleged to be infringing without prior notice and at our sole discretion.

7. RELATIONSHIP TO TERMS OF SERVICE

This DMCA Copyright Policy is incorporated into and forms part of our Terms of Service. By using the Site, you agree to comply with this policy.
